In order to suspend your license, the court will need to prove three items.

- Driver had a blood alcohol content (BAC) of .08 percent or greater while behind the wheel.
If you should be found guilty, you face your license being suspended for a total of a year, four months by criminal courts and six months by the DMV to run concurrent. Fines as low as $390 and not to exceed $1000, and a minimum of 48 hours jail time. A restricted license may be obtained for the purposes of only driving back and forth to work and school only and attend Alcohol Education classes.
A SR 22 (a type of insurance) will need to be on file with the DMV for the next three years. If the driver refused to take the BAC test, then their license will be suspended for a year with no possibility to obtain a restricted license. The driver will also need to file a SR22 in order to have the license reinstated at the end of the one year suspension period.
